The University of Colorado is seeking to dismiss a lawsuit by controversial former ethnic studies professor Ward Churchill.
CU says its regents have immunity from lawsuit. They fired Churchill in July for academic misconduct but he says he was wrongly terminated in his case in state court.
The school reviewed his Indian scholarship after he compared the victims of the September 11, 2001, terrorist attacks to Nazis. During the controversy, Churchill's alleged Indian heritage became an issue but it was not a consideration in the CU review. Churchill has claimed Cherokee, Cree and other ancestry.
