All five South Dakota Supreme Court justices have recused themselves Bill Janklow's appeal of his felony manslaughter conviction.

When he was governor, Janklow (R) appointed all five justices. A new set of judges has been appointed to replace them.

Janklow has two issues before the high court. One is to overturn his guilty conviction for the death of motorcyclist Randy Scott. The other is an appeal of a lower court judge's refusal to release him from jail pending the appeal of his conviction.

Janklow is serving 100 days in jail.
