Judge has discretion in sentencing Janklow

The South Dakota judge who will sentence outgoing Rep. Bill Janklow (R) for felony manslaughter and other crimes has a wide range of options. Although Janklow faces up to 11 years in prison, state law does not require a minimum sentence. The judge could impose no jail time or even probation. He would consider other factors, including Janklow's driving record, before he makes his decision. Janklow would then have 30 days to say whether he will appeal. In the meantime, the state Republican party is looking for a candidate to go up against Democrat Stephanie Herseth for the special election that will be held June 1. Former Rep. John Thune, who lost the 2002 Senate race to Tim Johnson, a Democrat, is considered a likely choice. Janklow's office in Washington, D.C. will remain open until the election.
