Court will entertain Makah whale hunt rehearing

A federal appeals court last week said it would entertain the possibility of rehearing a case involving the Makah Nation's whale hunt.

But for now, the 9th Circuit Court of Appeals said it would uphold a decision that bars hunting without additional environmental assessments. A December 2002 decision from the court found that the tribe's treaty rights were tempered by a federal law protecting the gray whale.

The whale is not in danger of dying out, according to government statistics, but animal-rights activists contend the tribe's hunt is unlawful. They have fought the tribe for several years.

The tribe successfully killed one whale in 1999. The tribe has a long tradition of hunting but stopped in the early 1900s due to non-Indian exploitation worldwide.
