10th Circuit declines to reopen Wind River jurisdiction case





It looks like a member of the Northern Arapaho Tribe of Wyoming has exhausted all of his attempts to reopen his murder and jurisdiction case.

Andrew Yellowbear Jr. was convicted in Wyoming state court for first-degree murder. He is serving a life sentence for killing his 22-month-old daughter.

The crime took place in Riverton in July 2004. Yellowbear contends that the town is still part of the Wind River Reservation but the state courts have repeatedly disagreed in cases dating back to the early 1900s.

Yellowbear then took his fight to the federal court system. But so far, the 10th Circuit Court of Appeals has refused to reopen the case, with the latest ruling coming down last Thursday.

Yellowbear could appeal to the U.S. Supreme Court. Earlier this year, the justices refused to hear his petition in one of his cases.
