Dissenting judge suggested tribe wanted casino

The 2nd Circuit Court of Appeals judge who dissented in Monday's ruling in favor of the Oneida Nation of New York suggested the tribe just wanted to "build another casino," The Utica Observer-Dispatch reports.

During oral arguments a year ago, Judge Ellsworth A. Van Graafeiland questioned the tribe's status. "You don't have to pay any taxes," he reportedly said, "but you can get all the benefits."

In an eight-page dissent yesterday, Van Graafeiland said there were "significant" questions over the continuous existence of the tribe.
