Trust fund battles continue
Assistant Secretary Neal McCaleb leaves his
job as head of the Bureau of Indian Affairs
this month but will remain a target in
the ongoing Indian trust fund lawsuit long
after he is gone.
McCaleb is being called to testify about the destruction of
e-mails against court orders.
A court investigator is preparing a report
on the incident, which could lead
to additional contempt sanctions.
Outside the court, tribes plan to press
Congress for legislative solutions to the
century-old problem.
Fractionation, the federal
budget and independent oversight of
the Department of Interior
are tops on the agenda for next year's
session.

Tribal self-determination has been the policy of
the federal government for more than 30 years
but it's not always backed up with
dollars.
Tribes seeking to take over
federal programs find that out
quickly.
But these budget shortfalls cannot
be challenged, the 10th Circuit
Court of Appeals ruled
this week in the second major case of
its kind.
The 9th Circuit is considering the same
issue and could arrive at a different
conclusion.
Depending on the outcome,
the Supreme Court could be asked
to settle the dispute once and for all.
