Court voids gas tax on Idaho tribes
Three Idaho tribes won a major victory this week
with a federal judge's ruling striking down
a tax on the sale of gasoline.
The tribes had already secured a state decision that threw
out the tax but lawmakers tried to find a way
to continue collecting the money.
U.S. District Judge David O. Carter said no
and ruled that the state had no authority over
Indian Country commerce.
Idaho officials hadn't decided if the
case would be appealed.
The state has lost all the major Indian law
cases in the federal court system
in recent years.

Cobell hits the road for trust fund
While the Indian trust fund battle
rages in court and among a joint federal-tribal
task force, Indian Country
is getting an update on a landmark
lawsuit filed on behalf of
500,000 Native Americans.
Elouise Cobell,
the lead plaintiff in the Individual Indian Money (IIM)
class action, visited Oklahoma this week to meet
with tribal leaders and account holders.
Along with attorneys handling the case,
she spoke of the struggles and victories
in her attempt to make the federal government
more accountable.
The updates come as a ruling in the Bush
administration's contempt trial is pending.
U.S. District Judge Royce Lamberth
is considering five charges against
Secretary of Interior Gale Norton and
Assistant Secretary Neal McCaleb.
