The Enterprise Rancheria sued the state of California on Wednesday, alleging bad faith in Class III gaming compact negotiations. The tribe and Gov. Jerry Brown (D) signed the compact two years ago this month. The complaint blames the California Legislature for failing to approve the agreement or suggest modifications. "The state has not negotiated in good faith with the tribe to enter into a tribal- state gaming compact, the complaint reads. "Although the governor initially negotiated and concluded a compact with the tribe, good-faith negotiations require that the entity with authority to ratify an agreement—in this case, the Legislature—either do so or convey its objection to the negotiating parties so that an agreement can be reached. Here, the Legislature has done neither, even though the compact was transmitted to the Legislature nearly two years ago." The tribe wants the state to come back to the table in 60 days. If that fails, the tribe will ask the Bureau of Indian Affairs to issue Class III gaming procedures. The tribe plans to build a casino on a 40-acre site in Yuba County.
