Opponents of the Seneca Nation off-reservation
casino in downtown Buffalo, New York, are planning to appeal after losing the latest round in court.
The tribe acquired the site of the Seneca Buffalo Creek Casino in connection with the Seneca
Nation Settlement Act of 1990. The land is held in "restricted fee" status so it is not subject to the regulations governing Section 20 of the Indian Gaming Regulatory Act, Judge William M. Skretny said in a ruling on May 10.
The case will be going to the 2nd Circuit Court of Appeals, according to Citizens for a Better Buffalo. The group is a plaintiff in the lawsuit.
"The Plaintiffs plan to appeal the decision and feel confident that the 2nd Circuit Court of Appeals will agree that federal law does not allow casino gambling in downtown Buffalo," the group said on its Facebook page.
