A federal judge has dismissed a lawsuit that sought to bar the Interior Department from taking land into trust for tribes in New York.
U.S. District Judge David Hurd said the Citizens Equal Rights Alliance and the Central New York Fair Business Association filed their suit too early. No final decision has been made on any of the land-into-trust applications, Hurd said.
The groups wanted DOI to study all of the land-into-trust applications at the same time. The Oneida Nation, the Cayuga Nation, the St. Regis Mohawk Tribe, the Seneca-Cayuga Tribe of Oklahoma, the Oneida Nation of Wisconsin and the Stockbridge-Munsee Band of Mohican Indians of Wisconsin have pending requests.
The groups also claimed DOI lacked authority to taken land into trust in New York and the original 13 Colonies.
