The 2nd Circuit Court of Appeals has sent the Cayuga Nation's land rights case back to a federal judge for further proceedings.
The appeals court did not vacate a preliminary injunction the tribe won against the village of Union Springs. The injunction blocked the village from interfering with the tribe's Class II facility.
But now that the U.S. Supreme Court has ruled in the Oneida Nation case, the village hopes to close the facility. A village lawyer said the Cayuga Nation land is not Indian Country.
A tribal lawyer said the case is different from the Oneida one. The tribe has agreed to allow county inspections of its gas stations without conceding any sovereignty issues. A test by Seneca County took place yesterday without incident.
