The Miccosukee Tribe of Florida plans to challenge a new Environmental Protection Agency rule that will allow polluted water to continue to flow into the tribe's homeland.
The tribe sued to stop the pumping of polluted water into the Everglades. The U.S. Supreme Court said the case could go forward.
But the EPA decided it won't force local and state governments to seek Clean Water Act permits for water transfers like the ones at issue in the lawsuit.
