A preliminary hearing was held in Provo, Utah, on Thursday as non-Indians testified they used peyote supplied by a man who admits he cannot prove he is American Indian.

Nevertheless, James "Flaming Eagle" Mooney and his wife, Linda, defend their possession and distribution of peyote. The hallucinogenic is classified as illegal but federal law allows exemptions for members of the Native American Church who are Indian.

Mooney says he is Seminole but cannot prove his ancestry.
