AUGUST 4, 2000 The Appellate Division of the New York Supreme Court says the state can legally refuse to collect taxes on goods sold on Indian land to non-Indians. Non-Indian business owners tried to argue Indian businesses have an unfair advantage. They wanted the state to collect taxes on tobacco and gasoline when sold to non-Indians. The court said the state has a rational basis not to collect taxes due to tribal sovereign authority and immunity. Get the Story:
