Mont. tribes appeal tax ruling

TUESDAY, SEPTEMBER 18, 2001 The Assiniboine and Sioux tribes on the Fort Peck Reservation in Montana announced on Monday they have asked a federal appeals court to declare their railroad tax lawful. A federal judge has struck down the tribes' 4 percent tax on Burlington Northern Santa Fe Railroad. U.S. District Judge Jack Shanstrom said the tax is unlawful in light of recent Supreme Court decisions limiting tribal authority on non-Indian owned land within a reservation. The tribes say they will lose $1.3 million annually out of a $9.5 million budget if the tax is not reinstated. Get the Story:
