N.Y. court refuses tax case

JULY 6, 2001 The New York Court of Appeals on Tuesday rejected a case which seeks to force Indian businesses to collect and remit state sales tax. The decision lets stand a lower court ruling which said the state could not require the collection of the tax. Off-reservation businesses say Indians have an unfair advantage but the courts have said the state can exercise its discretion and sovereignty not to collect taxes from sales to non-Indians.
