MARCH 6, 2001

The Supreme Court on Monday declined without comment a challenge made by several states and private industry to air pollution regulations advanced by the Environmental Protection Agency.

The regulations required 22 states and the District of Columbia to submit plans for eliminating toxic emissions of nitrogen oxide. The states and private industry said the rules didn't take into account how each state contributes to pollution but yesterday's action means a District of Columbia Court of Appeals decision upholding them will stand.
