The Food and Drug Administration is seeking public comment on whether certain policies violate the First Amendment.

In a document made public yesterday, the FDA said recent court decisions were driving the request. No specific policies were named but comment is sought on product labels and advertising.

The notice will be published in the Federal Register tomorrow.
