Citing executive privilege, a federal judge in New York is refusing to allow the Oneida Nation to question Gov. George Pataki and a top aide under oath of gaming negotiatoins gone bad.

But U.S. Magistrate Judge Randolph Treece said the tribe could depose two other past and present Pataki administration officials on claims the governor negotiated in bad faith on a proposal to allow video gaming at the Turning Stone Casino in upstate New York.

The state sued the tribe to prevent the games from being offered. The tribe in response says the governor's attempt to gain a share of the revenues shows the lawsuit should be dismissed.

The Oneida Nation may be getting one of three casinos in the Catskills under an economic stimulus bill Pataki has signed into law.
