Most counts dismissed over Navajo shooting death
A federal judge has dismissed all but one count and has removed some defendants in a lawsuit over the shooting death of a Navajo Nation, man.

Clint John was shot and killed by a police officer in Farmington, New Mexico, in June 2006. His family filed a lawsuit against the officer, top police officials, and the city of Farmington.

But Judge Bruce D. Black dismissed every count except one -- for excessive force -- and he removed two top police officials as defendants. The city of Farmington and Sgt. Shawn Scott, who fired the shots, remain as defendants.

John's family wants to settle but the city has rejected offers. A trial is set for May 18.
