Members of the Blackfeet Nation of Montana are seeking to mediate a lawsuit over homes they say are causing health problems.

More than 150 homeowners brought suit against the Department of Housing and Urban Development. They blame medical problems, from asthma to sinusitis, on the materials to build the homes. They also said they were exposed to toxic mold.

In January, a federal judge said the government can't be sued and that the tribe hadn't waived its sovereign immunity. The homeowners appealed to the 9th Circuit Court of Appeals and hope HUD will respond to mediation.
