A decision in a lawsuit that seeks to preserve the "Fighting Sioux" nickname and logo of the University of North Dakota will come by Christmas, a judge said.

Several members of the Spirit Lake Dakotah Nation filed the suit. They say they are honored by the use of the "Sioux" name and the school's depiction of Indians.

The state contends the tribal members lack standing to sue because they aren't parties to an agreement that calls on UND to eliminate the "Fighting Sioux" name and logo without the support of the Spirit Lake Dakotah Nation and the Standing Rock Sioux Tribe.

The Spirit Lake Dakotah Nation has passed a resolution to back the name but the Standing Rock Sioux Tribe hasn't taken action. The Spirit Lake tribal members say the Standing Rock Sioux Tribe should be given more time to consider its position.
