A judge ordered the North Dakota Board of Higher Education to delay a decision on the "Fighting Sioux" nickname and logo of the University of North Dakota.
The decision came in a lawsuit filed by members of the Spirit Lake Dakotah Nation. They said members of the Standing Rock Sioux Tribe should be given time to vote on the "Sioux" name.
Judge Michael G. Sturdevant didn't rule on the merits of the lawsuit. But his order prevents the state from taking action until December 9 at the earliest.
The state has been moving to get rid of the name because the Standing Rock Sioux Tribe hasn't indicated it will hold a referendum on the issue. Chairman Charles W. Murphy has said the tribe has higher priorities.
