9th Circuit tosses Bush's Klamath River plan


The 9th Circuit Court of Appeals issued a unanimous decision on Tuesday invalidating the Bush administration's Klamath River plan.

A three-judge panel held that the plan fails to protect the coho salmon. The court ordered the administration to come up with a new plan that will take into account the life cycle of the fish.

The Yurok Tribe and the Hoopa Valley Tribe are parties to the lawsuit. They are seeking to have more water returned to the river in order to ensure salmon can survive. Both tribes have treaty and water rights in the Klamath River basin.
