The Little Traverse Bay Bands of
Odawa Indians and the state of Michigan are asking a federal judge to close the Bay Mills Indian Community off-reservation casino.
The Little Traverse Bay Bands and the state say the Bay Mills casino site does not quality for gaming under the Indian Gaming Regulatory Act. The Obama administration agrees but is not a party to the litigation.
A hearing is expected soon on the request to shut down the casino. The Bay Mills Indian Community is raising a sovereign immunity defense and says the court lacks jurisdiction to hear the case.
The tribe opened the casino in November. A bigger facility will debut tomorrow.
