Generally, land acquired after the Indian
Gaming Regulatory Act of 1988 can't be used for gaming.
But the law contains an exception for land acquired in connection with a land claim settlement. According to the Bureau of Indian Affairs, a 53-acre site that was purchased by the Tohono O'odham Nation in 2003 qualifies for the exception.
The Gila River Indian Community, however, wants the BIA to take another look at the issue. The tribe says the Tohono O'odham Nation has already satisfied the settlement in the Gila Bend Indian Reservation Lands Replacement Act of 1986.
The law provided $30 million to the tribe so it could acquire up to 9,880 acres. At issue is whether the Tohono O'odham Nation has already exceeded the acreage limit.
In a similar case involving the Wyandotte Nation of Oklahoma, the BIA took several tries to determine whether tribe purchased land with settlement funds. The tribe eventually won the right to open a casino after more than a decade of litigation.
