The American Civil Liberties Union is considering a lawsuit to block the expansion of the commission in Charles Mix County, South Dakota.
On behalf of members of the Yankton Sioux Tribe, the ACLU sued the county over the commission's voting system. The county agreed to redraw its districts to include one with an Indian majority.
As the lawsuit was proceeding, county voters approved an expansion of the commission from three seats to five seats. The ACLU says the move is an attempt to dilute the power of Sharon Drapeau, who was recently elected to the commission.
About 30 percent of the county's population is Indian.
