The Association of Responsible Cigarette Sellers, a group of retailers in New York, sued the state on Wednesday to overturn a law banning Internet, telephone and mail order tobacco sales.
The lawsuit was filed in state court. It charges that the law violates the Indian Commerce Clause of the U.S. Constitution, which reserves regulation of commerce with tribes to the federal government.
The state is already facing a lawsuit on taxation. The New York Association of Convenience Stores filed suit on Tuesday to force the collection of taxes on goods sold to non-Indians on reservations.
