The Department of Justice is asking the U.S. Supreme Court to reinstate the Cayuga land claim, The Syracuse Post-Standard reports.
The 2nd Circuit Court of Appeals rejected the 64,000 acre claim last year, saying the Cayuga Nation of New York and the Seneca-Cayuga Tribe of Oklahoma waited too long to file suit.
The 2nd Circuit cited the Supreme Court's decision in another New York tribal case.
The Cayuga tribes are asking the Supreme Court to overturn the decision but no briefs have been filed. The tribes have received two extensions to file their opening petition.
