The Cayuga Nation of New York and the Seneca-Cayuga Tribe of Oklahoma plan to challenge a decision that dismissed their 25-year-old land claim, lawyers for the tribes said.
The lawyers said they ask a full panel of the 2nd Circuit Court of Appeals to rehear the case. If that fails, they will ask the U.S. Supreme Court to review it.
In a 2-1 decision, a split panel of the 2nd Circuit dismissed the entire 64,000-acre claim on June 28. The judges said the tribes waited too long to file the lawsuit, citing the recent U.S. Supreme Court decision in the Sherrill case.
