The state of Rhode Island is asking the 1st Circuit Court of Appeals to rehear the Narragansett Tribe's smoke shop case.
The state says a three-judge panel erred by ruling that the tribe has a right to sell tax-free cigarettes to Indians. The court said the state violated the tribe's sovereignty by raiding the reservation and shutting down the smoke shop.
The tribe is asking the 1st Circuit to order the state to return the money and property seized during the raid.
