A group fighting the Oneida Nation plans to refile a lawsuit seeking to force the tribe into complying with a local law banning smoking in public places.
Upstate Citizens for Equality didn't name the tribe in the case. Instead, the group sued the Oneida County Health Department for failing to enforce the ban on tribal lands, citing the recent U.S. Supreme Court decision in the tribe's case.
But since the UCE president personally served the legal papers on the department, a judge threw out the case.
