Judge refuses tribal request to halt Yucca Mountain

A federal judge on Tuesday rejected an attempt by leaders of the Western Shoshone Nation to block the Yucca Mountain nuclear waste repository in Nevada.

U.S. District Judge Philip Pro said the tribal leaders couldn't demonstrate ''immediate and irreparable'' harm because the site is still under construction and a rail line hasn't been built, according to the Associated Press. He did not dismiss the lawsuit outright, however, although the Bush administration has filed a motion to dismiss.

Yucca Mountain is located within territory covered by the 1863 Treaty of Ruby Valley. The Timbisha Shoshone Tribe, the Te-Moak Tribe and the Western Shoshone National Council say the treaty doesn't allow a nuclear waste dump on tribal lands.
