Bill Myers, the Interior Department's former top lawyer, is viewed as the most expendable in the escalating fight over President Bush's controversial judicial nominees.
The Denver Post says Myers may be left out of a deal to confirm some of the nominees. Republicans and Democrats have been meeting behind closed doors to discuss ways to end their stalemate over Bush's picks without resorting to the so-called "nuclear" option.
Myers is nominated for on the 9th Circuit Court of Appeals, which hears a large number of Indian la cases. Tribes and tribal organizations unanimously oppose the nomination, citing Myers' record on sacred sites, sovereignty and the trust relationship.
