The U.S. Supreme Court today rejected a petition in Brown
v. Rincon Band of Luiseno Mission Indians, a gaming compact case.
The justices declined the petition without comment in today's order list.
The move is good news for the Rincon Band of Luiseno Indians in California.
The 9th Circuit Court of
Appeals ruled that former governor Arnold Schwarzenegger (R) negotiated in
bad faith by demanding revenue sharing provisions in a new compact with the tribe.
The Department of Justice said the request violated the purpose of the Indian
Gaming Regulatory Act.
Gov. Jerry Brown (D) has negotiated at least one new gaming compact with another tribe that does not impose a high revenue sharing rate.
