The Bay Mills Indian
Community of Michigan will ask the 6th Circuit Court of Appeals for permission to reopen its off-reservation casino.
The tribe shut down its casino in Vanderbilt on Tuesday. A federal judge ruled that the gaming site is not on Indian land, as required by the Indian
Gaming Regulatory Act.
The tribe acknowledges it didn't go through the land-into-trust process for the casino. But it says it acquired the site in connection with a land claim settlement.
A similar issue arose in New York with the Seneca Nation, whose off-reservation casino is still being challenged in court.
