Another suit filed over Tohono O'odham off-reservation casino

Arizona Attorney General Tom Horne has filed a lawsuit in hopes of stopping the Tohono O'odham Nation from building an off-reservation casino.

Horne claims the tribe misled voters during the campaign for Proposition 202, an Indian gaming initiative. In 2002, he said the tribe promised not to build casinos away from existing reservations.

A year later, the tribe purchased land that it now wants to use for a casino.

Horne's lawsuit was filed in federal court. The Gila River Indian Community has joined as a plaintiff.

The new lawsuit is separate from one that was filed by Gila River and the city of Glendale. The tribe and the city are suing the Bureau of Indian Affairs to prevent the Tohono O'odham Nation's land from being taken into trust.

A hearing in the case takes place in federal court in Phoenix on Thursday.
