Supreme Court to weigh petitions in four Indian law cases





The U.S. Supreme Court will be considering petitions in four Indian law cases next month.

On June 16, the justices will consider Miccosukee Tribe v. Kraus-Anderson Construction, a tribal court jurisdiction case. The petition is unusual in that both the Miccosukee Tribe of Florida and Kraus-Anderson Construction Co., a non-Indian firm, want the high court to overturn an 11th Circuit Court of Appeals decision but the Department of Justice is recommending against it.

Also on June 16, the justices will consider South Dakota v. Yankton Sioux Tribe, a reservation diminishment case. The Yankton Sioux Tribe and the DOJ are urging the court not to review an 8th Circuit Court of Appeals decision that defined what lands are part of the reservation.

The next week, on June 23, the justices will consider Brown v. Rincon Band of Luiseno Mission Indians, a gaming compact case. The Rincon Band of Mission Indians and DOJ say the high court should not review a 9th Circuit Court of Appeals decision that held California in bad faith for compact negotiations.

Also on June 23, the justices will weigh Osage Nation v. Irby, another reservation diminishment case. The Osage Nation of Oklahoma wants the court to overturn a 10th Circuit Court of Appeals that said the reservation was diminished by an act of Congress but DOJ is recommending against it.
