After winning a preliminary injunction in federal court, the Oneida Nation said it wants to negotiate tobacco tax issues with the state of New York.
Judge David Hurd called the state's tax plan "unconstitutional" and said it "impinges" on the tribe's sovereignty. He ordered both sides to enter into mediation.
"The Oneida Nation is pleased that the federal district court has halted an attempt by New York state to circumvent the nation's sovereignty," a spokesman said in a statement. "We remain convinced that these issues are best resolved through negotiation."
The preliminary injunction comes as other tribes continue to challenge the tax plan. So far, the Seneca Nation, the Cayuga Nation and the St. Regis Mohawk Tribe have secured temporary restraining orders against the state.
The tax was due to go into effect on September 1.
