Tribes are hopeful the Obama administration will offer a fix to the U.S. Supreme Court decision in Carcieri v. Salazar.

A fix could come through an act of Congress or through administrative action. The Interior Department held three consultation sessions this summer to discuss potential solutions.

'I think the aim of the Secretary is to make sure all federally recognized Indian tribes have the same opportunity to acquire land into trust and to make sure that the Carcieri decision of this past February is not an impediment — cannot be — an impediment for such a goal,” said George Skibine, a Bureau of Indian Affairs official, The Westerly Sun reported.

The decision restricts the land-into-trust process to tribes that were "under federal jurisdiction" in 1934. Tribes warn of costly and protracted litigation without a fix.
