The Bureau of Indian Affairson Wednesday held the final consultation on the U.S. Supreme Court
decision in Carcieri
v. Salazar.
The decision restricts the land-into-trust process to tribes that were "under federal jurisdiction" in 1934. That could affected recently recognized tribes.
But the Mashpee Wampanoag
Tribe of Massachusetts said its status as a tribe was clear in 1934 even if it didn't gain formal recognition until May 2007. "In 1934, the Indian town, governed by tribal members, was no less a tribe than it is today," Chairman Cedric Cromwell told assistant secretary Larry EchoHawk, The Cape Cod Times reported.
Cromwell asked EchoHawk to address the decision. A "fix" could be enacted by Congress or could be resolved through administrative means at the Interior Department.
