A leader of Pojoaque Pueblo in New Mexico has been charged in connection with a fatal hit and run on the reservation.

Lt. Govenor Linda Diaz was indicted in federal court on a felony charge of leaving the scene of a fatal accident and failing to render aid, the U.S. Attorney's Office said. She is accused of striking and killing Phillip Espinoza in early April.

Espinoza was non-Indian so the U.S. Attorney cited state law in charging Diaz, The Santa Fe New Mexican reported. Had the victim been Indian, there would be no corresponding federal statute for a hit and run accident.

Diaz has retained Sam Winder, a former federal prosecutor.
