A judge in New Mexico agreed to a one-delay into the trial of a man accused of the drunken driving death of William Tenorio of San Felipe Pueblo.

Carlos Fierro, 36, will go to trial on September 21 on charges of vehicular homicide and causing a fatal accident. He allegedly struck and killed Tenorio on November 26, 2008, and fled the scene.

Fierro's attorneys sought to exclude evidence related to Fierro's blood samples but the judge rejected the motion.
