The Makah Nation of Washington has delayed a trial for five members accused of an illegal whale hunt.
The men were set to go to trial tomorrow but the tribe doesn't have a judge to hear the case.
The men also face a trial in federal court in March.
The tribe has a right to hunt whales under an 1855 treaty. But the 9th Circuit Court of Appeals ruled that the tribe must seek a permit under the Marine Mammals Protection Act. The process is ongoing.
