North Dakota lawmakers have approved a bill that gives the governor two years to reach an oil tax agreement with the Mandan, Hidatsa and Arikara Nation.
The deal would resolve taxation and regulatory issues regarding oil production on the Fort Berthold Reservation. It would affect land held in trust as well as land held in fee status.
The bill requires all oil production on the reservation to be subject to the state's 5 percent production tax. An additional 6.5 percent extraction tax is open for negotiation.
Tax revenues would be shared between the tribe and state. On trust land, the revenue is equally split but on fee land, the tribe only gets 20 percent.
