The Golden Hill Paugussett Tribe asked the 2nd Circuit Court of Appeals to reinstate the tribe's claim to ancestral land in Connecticut.
The case was dismissed by a federal judge due to the tribe's lack of federal recognition. After several reconsiderations, the Bureau of Indian Affairs said the tribe did not meet all the criteria.
The tribe says the judge relied too heavily on the BIA's decision. But the state says the tribe has little chance of getting the claim reinstated.
The 2nd Circuit has set precedent on land claims, ruling that tribes who waited to long to file a lawsuit have lost their rights. A judge in New York applied the precedent in dismissing the land claim of the Shinnecock Nation, another unrecognized tribe.
