Non-Indians in Thurston County have filed a lawsuit against the Omaha Tribe's gasoline tax agreement with the state of Nebraska.

The non-Indians, including the owners of two gas stations, claim the agreement gives the tribe jurisdiction over gas stations in Pender. They say Pender is not part of the reservation. The lawsuit alleges the tribe can't collect taxes on the sale of gasoline to non-Indians.

The tribe and the state reached the agreement to allow the collection of a tribal gasoline tax.
