The state of South Dakota has been cleared to appeal an Indian voting rights case.

The state is being accused of packing members of the Oglala Sioux Tribe and the Rosebud Sioux Tribe into one legislative district. A federal judge said the plan violated the voting rights of tribal members. U.S. District Judge Karen Schreier then drew her own boundaries.

The state plans to take the case to the 8th Circuit Court of Appeals. Schreier ruled that the appeal can proceed without having her map reviewed by the Department of Justice. The state will seek to continue to follow the current boundaries while the case is processed.
