The Seneca-Cayuga Tribe of Oklahoma and the Cayuga Nation of New York asked the 2nd Circuit Court of Appeals to rehear their land claim.
On June 28, the court threw out the 64,000-acre claim. In a 2-1 decision, the court said the tribes waited too long to file suit.
The tribes now want an en banc panel of the 2nd Circuit to rehear the case. They say the earlier panel misinterpreted the U.S. Supreme Court's recent ruling in the Oneida Nation case.
If the petition rehear the case is denied, the tribes could appeal to the Supreme Court.
